บุคคลหรือนิติบุคคลที่มีทั้งถิ่นที่ตั้งอยู่ในสหภาพยุโรป ที่ไม่ได้เป็น ผู้ผลิตหรือผู้นำเข้าสารเคมี ที่ใช้สารเคมี ทั้งที่อยู่ในรูปสารเคมีหรือในรูปเคมีภัณฑ์ ในกิจกรรมเชิงอุตสาหกรรมหรือการใช้งานแบบมืออาชีพ

ผู้จัดจำหน่าย หรือผู้บริโภค ไม่ถือเป็น ผู้ใช้ในสายโซ่การผลิต และให้ถือว่า ผู้ที่นำสินค้ากลับเข้ามาในยุโรป (Re-importer) ที่ได้รับการยกเว้นตามมาตรา 2(7)(c) เป็นผู้ใช้ในสายโซ่การผลิต

(“any natural or legal person established within the Community, other than the manufacturer or the importer, who uses a substance, either on its own or in a preparation, in the course of his industrial or professional activities. A distributor or a consumer is not a downstream user. A re-importer exempted pursuant to Article 2(7)(c) shall be regarded as a downstream user”)

บุคคลหรือนิติบุคคลที่มีทั้งถิ่นที่ตั้งอยู่ในสหภาพยุโรป รวมถึงผู้ขายปลีก ที่เป็นเพียงผู้เก็บรักษาและวางตลาดสารเคมี ทั้งที่อยู่ในรูปสารเคมีหรือในรูปเคมีภัณฑ์ ให้กับบุคคลที่สาม

วัตถุที่ถูกนำมาผลิต/แปรรูปจนได้เป็นวัตถุที่มีรูปทรง พื้นผิว หรือ ดีไซน์พิเศษ ที่เป็นลักษณะสมบัติเป็นตัวกำหนดประโยชน์ใช้สอยของวัตถุนี้ มากกว่าส่วนผสมทางเคมีของวัตถุนั้นๆ

(“an object which during production is given a special shape, surface or design which determines its function to a greater degree than does its chemical composition”)

ผู้ผลิตสารเคมี ผู้นำเข้า ผู้ใช้ในสายโซ่การผลิตหรือผู้จัดจำหน่าย ที่นำสารเคมีเข้าตลาด ทั้งที่อยู่ในรูปสารเคมีหรือในรูปเคมีภัณฑ์

("supplier of a substance or a mixture means any manufacturer, importer, downstream user or distributor placing on the market a substance, on its own or in a mixture, or a mixture;")
